Court dismisses Multimedia Ltd’s motion

The Agona Swedru High court has dismissed   a motion seeking for the transfer of a defamation suit against Multi Media Group of Company and three others to Accra.

The court presided over by Justice Peter Dei Ofei ruled that the transfer of a case from one Court to another rest solely with the Chief Justice (CJ) of Ghana.

It ruled that no Judge has the capacity and power other than CJ to transfer suits by law.

The court said that granting of the motion cannot be possible because the defendants\applicants in the case operates as well in the Central region.

The motion filed by Defense Counsel, Mr Sampson Lardy Anyinini prayed the court to transfer the suit filed by the Gomoa East  District Coordinating Director, Mr Emmanuel Baisie, against Multimedia and three others, namely Nana Captain Smart, presenter, Mr Kwadwo Fordjour, producer and Mrs Emma Ahunu-Armah wife of the late District Chief Executive of Gomoa East.

Mr Ishmael Kofi Takyi Turkson ESQ and Mr Partick Asamoah ESQ representing the plaintiffs filed the suit to claim GH¢500,000 from four defendants for alleged defamatory statements in respect of final funeral rites of late DCE for Gomoa East, Mr Isaac Kingsley Ahunu-Armah.

Madam Comfort Asabea, mother of District Coordinating Director is a co-plaintiff. 

The court also awarded cost of GH¢1,000 each against the four defendants.
