Court orders PPP, EC to file statements of case

LawA High Court in Accra has granted the Electoral Commission‘s request for abridgement of time in the case in which the Progressive People’s Party (PPP) is seek a restraining order against its commissioner.

The court also ordered the Electoral Commission (EC) and PPP to file their statements of case by Monday, October 24.

The parties on Tuesday, October 25 are expected to make oral submissions before the court after which a date would be fixed for the delivery of the ruling.

The court presided over by Mr Justice Eric Kyei -Baffour ruled: “Having heard both counsels and read the application for abridgement of time, the court is of the view that time was of essence and there was the need to ensure that the declaration by the respondent towards the December 7, polls was not halted by the court proceedings.

“I therefore grant the application as prayed.”

According to the court “the prayer by the applicant to abandon grounds three is hereby strike out.”

The court also acceded to the request of the applicant to send its supplementary affidavit via e-mail as the Presidential Candidate of the PPP was out of the jurisdiction.

The matter was therefore adjourned to October 25.

Mr Ayikoi Otoo who led the PPP legal team was not opposed to EC’s application for abridgement of time but indicated that he had some issues with some of the grounds of the respondents.
